    OMG, Duckadiledunee, what a crappy deal all the way around. I'm really glad that you didn't get badly injured but I'm so sorry about your beloved bike. Though your bike looks worse for the wear (those photos are painful to see), I'm glad to read that you're ok. Good luck getting this all sorted out.

    I don't know about the UK, but what DD said is the case here in the US. A driver who rear ends the vehicle in front of him or her is considered the driver at fault. I was hit from behind in my car about a year ago at a four-way stop intersection. Here in Tucson the police won't come to an accident unless "an ambulance has been called" or "a vehicle is blocking the flow of traffic". :rolleyes: I learned that when I called 911 after a collision that happened a couple of months earlier. Anyway, my insurance agent told me that the person who hits someone from behind is considered the party at fault.

    Never like to here of anyone crashing let alone a fellow forum member. I glad your ok mate.

    Theres a cheap body plastic suppy I havnt used cos I found them after I was sorted,, and import duty may be payable.

    Sorry to hear of your little mishap ducky I’m glad you’re not seriously hurt, tho I bet you feel like you’ve been hit by a bus this morning.

    I’m pleased you report the police attended and were helpful, so often these days they don’t and they aren’t, so that’s a positive as is the driver behind who is willing to be a witness.

    You say the police have cleared you of any wrongdoing but do you know if they reported the Audi driver for any offence, for instance careless driving? On the basis on the brief explanation of the incident if they haven’t reported you then I suspect they won’t have reported him either and write it up as 50/50 and allow insurance companies to deal which is where it gets shitty.

    The Audi’s insurers will argue its your fault for running into the back of him , as DD says difficult to defend, and your insurers will argue that he stopped and turned without warning leaving you no chance of avoiding him. What is certain is that both insurance companies will want to pay out the bare minimum and sort it between themselves and you will have to tick “yes” to the question “have you had any accidents in the last FIVE years” at every insurance renewal and take the hit in the pocket, even if you are judged totally blameless.

    There are faults with both parties. He shouldn’t have stopped suddenly in the circumstances you describe then turn without proper observation and signal and you should have been in a position to stop for an event occurring in front of you ( though I note you glanced away to check for busses at the very instant he stopped, just unfortunate timing).

    I wish you well ducky and hope the recovery is swift and pain free and I hope the matter gets sorted quickly.

    Ducky, I almost had the same thing happen today! Riding along to Loomies on a nice straight section of A272 at about 50 mph behind a line of cars. I wasn't in a hurry and was just plodding along. Then the driver (two cars ahead) hauled on the anchors to a standstill, put his indicator on for 1 flash and swerved turned right into a teeny side road.

    The car in front of me didn't realise what was going on and slammed their brakes on narrowly missing the twat doing the Crazy Ivan manoeuvre. Unfortunately even though I had more than the recommended 2 seconds gap between me and the car in front, the concertina effect meant that I had to be rather 'aggressive' with the brakes but 'just' (and I mean just) avoided bent forks...

    Twat driver probably didn't even know they were being a bit dangerous. Odd that it would still be our fault if we all piled into the back of him even though he didn't indicate in advance and decelerate gently. A case of 'without due care and attention' in my humble opinion.

    Sorry to hear of the excess! Insurance is fun isn't it?!? NOT!

    PS: I just noticed my new Avatar title - it's "First Class Member" - is that a euphemism?

    My bike has one of these installed. The video quality isn't top banana but does work. The advantage is that it records fore and aft, loops to reuse the memory card storage and is powered by the bike. It can be fitted really neatly (if ur as clever as me :joy:) and doesn't look unsightly, or indeed noticeable at all!

    I’ve got exactly the same on my bike and apart from shit sound as the mike is under the seat in the display/control unit it’s fine. I tend to format the card after a ride if I’ve been a little naughty. ( I’m not as naughty as I used to be Jez);)

    Mine just records the audio of the engine and a thrrrruuppp of the exhaust... Or at least I thought it did. It turns out its actually recording the sound of my anal sphincter spasming and the reverberations of my farts as I panic about some knob Head potentially pulling out of a Junction!

    That really sucks duck, if he was a real man he would offer to pay for your damages based on his own mistakes. That doesn't happen much anymore, unfortunately. As people are over leveraged in debt.

    Thanks for the helpful post, Yorkshireman! As I read this part of your post, I realized how lucky I am and / or that I made an excellent choice of insurer for my vehicles. I have Progressive, BTW. Anyway, about a year ago I was involved in not one but two collisions in the span of two months. Both were at the same four-way stop intersection that is one block from my garage door and is the only route (by car) in and out of our little neighborhood. In neither instance was there a witness. No one else was at that intersection for the first (and worst) accident and no one stuck around for the 2nd one (a low-speed rear ender). In neither case did the police arrive on the scene. I called 911 for the first collision and they wouldn't come. I didn't even bother the 2nd time.

    I won't bore you all with the details but my insurance company placed 100% of the blame for the first collision on the other driver. She told multiple different stories and her insurance company was a joke. I read a number of reviews of that company and found it had been reported to the Better Business Bureau and even to the State Attorney General's Office. Her company (Legacy--out of Phoenix) placed 100% of the blame on me based on what I don't know. I think it was based on not wanting to (or having the funds to) pay out. At any rate, Progressive sent the case to their subrogation department who found they just couldn't squeeze a dime out of Legacy.

    Anyway, my primary point in response to this part of your post, Yorkshireman, is this. In a rare and amazing instance of an insurance company doing the right thing by a client, my Progressive account doesn't even reflect an accident because they declared the other person 100% at fault based on photos, interview info, etc. And that the other driver changed her story three different times and none of the stories fit with photos, damage incurred, etc. My rates did not change one penny and nothing in any of my records indicates a collision. The second collision--where I was rear-ended by a Mercedes, was deemed 100% the fault of the Mercedes driver and didn't change my insurance records or costs either. Oh, I did eat my $500 deductible on the first accident and Progressive ate a $12,000 bill--11K of it was for repairs and the balance was for my six weeks with a loaner car.
