Driving In Excess Of 100mph

    I've just read through a round up of court appearances at Cannock Magistrates court.
    No fewer than 7 defendants pleaded guilty to driving in excess of 100mph on the M6 in the Cannock area in June and July this year, one in a 50mph speed limit area.
    It doesn't state that any were riding motorcycles?
    All received hefty fines and 6 points on their licences.
    None were disqualified from driving.
    I was a little surprised to see that.
    I had thought that this level of offending generally attracted a period of disqualification unless very expensive mitigation was proffered by a solicitor.
    This does not appear to be the case

    No surprise there mate. If it had been bikers I suspect the sentence’s would be very different :mad:

    True. However as an observation it could be argued that insurance companies are also a part of the punitive enforcement process.

    Sadly they do get it wrong too.

    Here’s a scenario. Son 2 has a car. Son one needs to get home from Grandma’s over Christmas. son two agrees to add son one to his insurance for a day as named driver. Son one writes off son twos car.

    Result son one has no black mark.

    Son two (who was eating Boxing Day dinner 100 miles away from the accident) now struggles to get affordable insurance.

    Seems unfair.

    There is no given speed which dictates an automatic ban. 30mph over the motorway limit means an enforced invite to court who will decide your fate, be it a fine, points, a ban or even prison for really heinous offences.

    Son one now has mental health issues so everyone tiptoes around any issues.

    Son One needs his arse kicking. If you borrow something, you should be extra careful with it. Perhaps he had too much elderberry wine at Grandma's.

    Regarding the 100 mph speeding on motorways, a lot depends on the circumstances, in the Magistrates Court there are usually 3 Magistrates sitting with one in the chair, at times it can be 2, or 1 if a District Judge is sitting, the Magistrates or District Judge listen to the evidence with both aggravating and mitigating circumstances, aggravating factors could be one lane closed with workpeople present, the speed was maintained over a long period, the motorway was very busy, previous penalty points or driving convictions, mitigating factors could be little traffic either early in the morning or late evening, good weather and visibility, advanced riding/driving qualifications, or in very very rare circumstances a risk to the persons personal safety or genuine emergency, a lack of any previous motoring convictions or penalty points, there is always a Legal Advisor present who literally advise the Magistrates on legal matters and outline the sentencing guidelines. You can have a Solicitor represent you, especially if the speed is very excessive, penalty points are always preferable to a disqualification even if it is only for a short period, the reason being insurance companies deem a disqualified driver as a greater risk and load your premium accordingly. Magistrates sentence on the guidelines, however these are not "tramlines" and one can argue for a penalty or sentence outside the guidelines, it is only when all the evidence is heard that an informed decision is made, a fine either band A - B or C with points or disqualification, Court costs and a Victim Surcharge extreme speeds and aggravating factors can lead to imprisonment, some speeding offences cross the community penalty threshold, there are no 2 cases alike, the speed may be the same but circumstances vary significantly, new guidelines were introduced in June 2021.
